Maharashtra Bans Housing Society Committee Members and Relatives From Becoming Developers in Mumbai Redevelopment Projects

Maharashtra has introduced stricter redevelopment rules to prevent conflicts of interest, improve transparency, and protect the interests of housing society members across the state.

The new provision prohibits managing committee members, office-bearers, and their relatives from becoming developers for the redevelopment of their own housing societies. The move aims to promote fair developer selection and ensure that redevelopment decisions are made in the best interests of residents.

Maharashtra Introduces New Rules for Housing Society Redevelopment

The state government has included the new restriction in revised guidelines issued by the Cooperation Department under Section 79A of the Maharashtra Cooperative Societies Act.

According to the Government Resolution (GR), committee members and office-bearers cannot take up the role of developer for their society's redevelopment project. The same restriction applies to their relatives.

The provision is designed to reduce the risk of personal interests influencing important decisions, prevent the misuse of authority, and make the developer selection process more transparent.

The revised rules are particularly important for Mumbai, where redevelopment plays a major role in improving aging residential buildings and providing better housing facilities to residents.

Maharashtra Sets Clear Approval Rules for Redevelopment Projects

The Maharashtra government has also strengthened the process for approving redevelopment proposals. Under the Government Resolution issued on September 30, 2026, societies must follow specific requirements for member participation and approval before moving forward.

A redevelopment proposal requires a quorum of two-thirds of the society's members and approval from at least 51% of the total membership. These requirements aim to ensure that redevelopment decisions receive sufficient participation and support from residents.

The guidelines also allow eligible members to participate through video conferencing or other remote communication systems. This facility is available to senior citizens, members living abroad, critically ill individuals, persons with disabilities, and those unable to attend meetings for unavoidable reasons.

Members who support the redevelopment proposal must also provide their consent in writing.

Housing Societies Must Invite at Least Three Developer Bids

To encourage fair competition, the revised guidelines require housing societies to invite at least three competitive bids from developers.

If fewer than three bids are received, the society can extend the deadline to encourage more developers to participate. This approach is intended to give residents a wider choice and support a more transparent selection process.

The requirement also encourages societies to compare developer proposals carefully before making a final decision.

Maharashtra Sets Deadlines for Key Redevelopment Agreements

The revised rules introduce timelines for completing important legal documents to help prevent unnecessary delays in redevelopment projects.

Housing societies must execute the Development Agreement (DA) within three months. After the Development Agreement is registered, the registered Permanent Alternative Accommodation Agreement (PAAA) must be signed within the following three months.

These agreements are important for defining the redevelopment terms and protecting the housing and rehabilitation rights of existing residents.

What the New Redevelopment Rules Mean for Mumbai Residents

The new provisions aim to make redevelopment more transparent, accountable, and resident-focused. By restricting committee members and their relatives from becoming developers, the government seeks to reduce potential conflicts of interest during the selection process.

The rules on member approval, competitive bids, written consent, and documentation deadlines also provide a clearer framework for housing societies planning redevelopment.

For residents of older buildings in Mumbai and other parts of Maharashtra, these changes are intended to strengthen confidence in the redevelopment process and encourage decisions based on the collective interests of society members.
